How to Evict a Tenant

Hi, this is Frank Chen with REIClub.com, the only site you need as a real estate investor. Today I've got a quick video on how to evict tenants.

I decided to make this video because I can almost guarantee you there is someone out there who is dealing with problem tenants. So why might I consider evicting tenants?

  • Late rents or pays late or bounces checks frequently
  • Violate terms of the rental agreement or lease and has received written notice about this from the landlord and has not corrected the violation
  • Substantial damage to, the unit, or is “creating a substantial interference with the comfort, safety or enjoyment of the landlord or other tenants in the building
  • Unit being used for illegal purposes – drugs, bbq pit, business etc…
  • Refuse to execute the new contract after original expires – maybe doesn't like new terms
  • Non-approved resident within the dwelling

  • skip a step, the judge may decide in the tenant's favor

Give Notice

**Each of the 50 states has its own procedure for in listing the assistance of the law in dispossessing a tenant. All share the common feature of notice and an opportunity for the tenant to be heard before a law officer removes them from the property

  • “notice to vacate” letter
  • Standard 30-Days
  • Severity of reason – 72 Hours
  • must give tenant time to correct the action before filing
  • you must state the amount of time in the notice
  • include the date of delivery and date you will file the eviction
  • certified mail, deliver yourself, leave it on the door

File your property eviction

  • Some states are immediate
  • Some you can do after the morning after the waiting period
  • File at the court house – small fee
  • You will be given a hearing date, tenant will be contacted by Court

Get Ready For Court

  • Gather any documentation
  • Lease Agreement
  • Copy of the written notice – why certified mail in important
  • Banks Statements indicating missing rent payments, bounced checks
  • records of all communication between you and the tenant – emails?
  • Result: tenant will either stay, or be evicted by judge

Evict Tenant

  • Tenant has set amount of time to leave the property
  • Some states less than 48 Hours, some 5 days
  • If period expires – visit property with the sheriff
  • Sheriff will remove the tenant and place any personal possession on the curb
  • Bring a Camera – document major damages for further legal action.

As a real estate investor, business owner, it's important you follow the procedures and laws associated with rental eviction. No matter how frustrated you are, do not attempt to evict the tenant yourself. Changing the locks to the tenant's unit or the main door on the complex, removing the tenant's belongings, or shutting off the utilities can have serious legal repercussions. Most states allow tenants to sue a landlord who tries to self-evict, so don't give up your power by making small mistakes.
